State Agency

Autonomous Agency

The State Agency for Labour Inspection and Social Security is an autonomous agency created by Law 23/2015, Ordinator of the Labour Inspection System, attached to the Ministry of Labour and Social Economy through the Secretary of State for Labour.

Through Royal Decree 192/2018, its Statutes that regulate its central and peripheral structure, the bodies of management and institutional participation, and the economic, patrimonial and contracting regime.

Governing and governing bodies and institutional participation

In the central structure, as governing bodies, the Inspectorate has the Governing Council and with Directorand as an institutional participatory body, with the General Council.

Governing Council

It is the highest management body and is configured as a collegiate, joint body, formed by representatives of the General Administration of the State and the Autonomous Communities.

Its functions are those of proposing, promoting and approving the decisions of greatest importance for the life of the organism.

It operates in plenary and in permanent committee, and is responsible for the approval of its Internal Operating Regulations.

Director

Responsible for the representation and management of the agency, as well as its direction and government, acting as Central Authority according to Convention 81 of the International Labour Organization.

General Council

Institutional participation body that guarantees the collaboration of the most significant trade union and business organizations in the Labour and Social Security Inspectorate.

Central administrative structure

The organs of the central structure of the State Agency, with the level of General Sub-Directorate, dependent on the Directorate are:

  • The National Anti-Fraud Office.
  • The General Subdirectorate for the coordination of the inspection of the Labour Relations System.
  • The General Subdirectorate of Institutional Relations and Technical Assistance.
  • The General Secretariat.
  • The School of Labour and Social Security Inspection

Administrative structure of territorial scope

The ITSS is deployed territorially in the following units, under the authority of the Agency:

  • A Special Direction
  • A Territorial Direction in each Autonomous Community.
  • A Provincial Labour and Social Security Inspectorate in each province and in the Cities of Ceuta and Melilla.

  • Royal Decree 502/2024, of 21 May, which develops the basic organizational structure of the Ministry of Labour and Social Economy, and amends Royal Decree 1052/2015, of 20 November, which establishes the structure of the Departments of Employment and Social Security abroad and regulates their organization, functions and provision of jobs.
